This Privacy Notice tells you how Yum! Brands, Inc. and its affiliate entities (“Yum“, “we” or “us“) process your personal data when using SuperApp (the “App“). It also describes your data protection rights, including a right to object to some of the processing that Yum carries out. More information about your rights, and how to exercise them, is set out in the Your Choices and Rights section.

This Privacy Notice applies only to the personal data processing in connection with your use of the App. It is relevant to Yum’s equity employees and the employees of our franchisees to the extent that they are required to use the App as part of their job role.

We process the following types of personal data in connection with your use of the App.

  • Identification Data: such as your full name.
  • Employment Data: job title and role, work location, business unit division, employee ID number, and education and training history.
  • Technical Information concerning your use of IT tools: mobile and computer and connection information, including statistics on how you engage with our App, referral URL, IP address, unique device ID, browsing time, geolocation information, and web log information as well as information about your use of our electronic resources, such as mobile devices we may provide to you.
  • Any other information you submit to us in connection with your use of the App, including but not limited to any written comments or feedback

Why We Collect, Use and Store this Personal Data

We collect, use and store your personal data in connection with your usage of the App for the reasons set out below.

  • Where necessary for the legitimate interests (as listed below) of Yum and/or its franchisees, and where such interests are not overridden by your interests or data protection rights.

  • Managing and developing personnel – for example, by using the App as a learning hub and scheduling platform.
  • Providing employees with important notifications.

  • Maintaining the security and integrity of our equipment and electronic platforms. This includes administering access rights, monitoring compliance with company protocols, and where permitted by local law and in accordance with relevant policies, for investigations and disciplinary actions.

Relying on our legitimate interests

We have carried out balancing tests for all the data processing we carry out on the basis of our legitimate interests, which we have described above.

How We Share Your Personal Data

Yum may share your data third-party service providers to the extent that this is necessary for operating the App, and any such third-party service providers will be bound by appropriate data security obligations in relation to any processing of your data. If you are employed by one of Yum’s franchisees, Yum may also share your data with the relevant franchisee to the extent that this is necessary in the context of your job role.

In the event that any part of Yum’s business or any business unit is sold or integrated with another business (in part or whole), your details may be disclosed to our advisers and to any prospective purchaser’s adviser and will be passed to the new owners of the business / business unit.

Your Choices and Rights

You have the right to ask Yum for a copy of your personal data, or to correct, rectify, delete or restrict processing of your personal data. Where applicable, you may ask to us to transmit your data to another controller and obtain the personal data processed in connection with this Privacy Notice in a structured and machine-readable format. In addition, you can object to the processing of your personal data in some circumstances (in particular, where we do not have to process the data to meet a contractual or other legal requirement or compelling interest).

Where we have asked for your consent, you may withdraw consent at any time. If you ask to withdraw your consent to Yum processing your data, this will not affect any processing that has already taken place at that time.

These rights may be limited, for example if fulfilling your request would reveal personal data about another person, or if you ask us to delete information which we are required by law or have compelling legitimate interests to keep.

If you have unresolved concerns, you have the right to complain to the data protection authority or supervisory authority in the country you reside, where you work or where we are located.

To exercise any of these rights, or to obtain any other information, you can get in touch with us using the details set out in the Contact Us section below.

How Long We Keep Your Data

We will generally retain your personal data for the length of your employment and for a period of 6 years thereafter. Certain information may be kept for shorter or longer periods in accordance with applicable legislation or our internal operational requirements. If you are employed by Yum, you can find detailed information about the retention periods applicable to your employment records in our Retention Schedule.
